Ndimande brothers strengthen defence, ditch bail application

Another lawyer has been added to tighten the legal team of murder accused Ndimande brothers, Malusi Dave and Siyabonga Gezani, who abandoned their bail application during a hearing at the Durban Magistrate's Court on Friday morning. 

The Ndimande brothers, extradited from eSwatini in 2025, are facing charges for the murders of rapper Kiernan ‘AKA’ Forbes and his friend, chef Tebello ‘Tibz’ Motsoane. AKA and Tibz were shot dead on Florida Road in Durban in February 2023.

Information from an insider revealed that Advocate Bonga Zulu, who was seen in court going to check on his clients, has joined the team. It was also revealed that Advocate Simphiwe Mlotshwa, who has since placed himself on record for the brothers, was still part of their legal team. 

During court proceedings, their instructing attorney, Sibusiso Dlamini, said: “The record will reflect that on the last occasion the accused had intended to apply for bail. I have since received instructions that they are now abandoning their bail.” 

Senior State prosecutor, Advocate Elvis Gcweka, requested that the matter be postponed to April 17 so that the brothers could be served with indictments. This will allow them to join their five co-accused, Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimande, Siyanda Eddie Myeza, Mziwethemba Gwabeni, and Lindokuhle Lindo Ndimande, in the Durban High Court.

Magistrate Ashwin Singh granted the State’s request and confirmed with the duo that they had indeed abandoned their bail application.

Earlier in March, Dlamini had sought a court order for the brothers to be detained at Westville Prison for two weeks to facilitate more complete consultations, citing limitations at the Ebongweni Super Maximum Correctional Facility, where they are currently held.

However, Gcweka said the State was unaware of the reason for their detention at the super maximum prison and suggested that Correctional Services personnel be called to court to explain the move and the consultation limitations. 

This led to the brothers changing their minds at the last minute and instructing Dlamini, who is the instructing attorney for all seven men, that they want to apply for bail.
